Such a court decision can be recognised in Germany under procedural law. This can be concluded from the materials on the 2020 version of the European Service Regulation as well as from its Article 22 which is silent on documents that do not institute proceedings. Early on in 2020, the parties and counsel were somewhat skittish. The international rules preclude an award of punitive damages unless the parties agree otherwise. On the arbitration side, we quickly converted in-person hearings to hybrid or fully virtual ones. So it has to be in a New York Convention country.
