The Draft Treaty complements soft law in the same area, namely the UN Guiding Principles on Business and Human Rights. This holds for tort law (liability), criminal law, and administrative law. Such “mandatory due diligence” is also relevant in climate litigation ( Rajavuori, Savaresi & Asselt (2023).
