On November 30, 2023, the Higher Administrative Court Berlin-Brandenburg ruled in DUH and BUND v. The court concurred with this line of argument in its verdict (the details of which are pending as the reasons for the judgment have not yet been published). On the merits as well, the court ruled in favor of the plaintiffs.
