Beal’s proceeding was the 16th trial in consolidated litigation against 3M over its earplugs. The total amount of damages in the trials lost exceeds USD 300 million. The federal jury awarded Beal compensatorydamages to the tune of USD 5 million for hearing loss and tinnitus, and USD 72.5
In contrast to compensatorydamages, punitivedamages are awarded when a defendant commits deliberate, malicious, or fraudulent acts that cause harm to another person.
The litigation has not been going well for the network and it just lost another key motion to block an effort to depose Jake Tapper. Judge Roberts found that “Young sufficiently proffered evidence of actual malice, express malice, and a level of conduct outrageous enough to open the door for him to seek punitivedamages.”
Of these, 26 were successful cases where the Chinese courts decided to recognize and enforce foreign judgments while 3 were partially successful cases (the Chinese courts recognized compensatorydamages but rejected punitivedamages); the recognition and enforcement of foreign judgments were rejected in the remaining 34 cases.
Another interesting example would be a series of cases where a Chinese court in Guangzhou recognized and enforced compensatorydamages awarded in three U.S. EB-5 Visa fraud judgments, but rejected the punitivedamages awarded therein, echoing the same rule laid down in the 2021 Conference Summary.
The crew could sue for a reckless act on the set under these rules though members could face serious pre-trial litigation under the elements to these rules. They could also seek punitivedamages in such a case. Compensatorydamages cover both economic and non-economic damages.
