A US federal court in Texas set aside the Federal Trade Commission’s (FTC) new ban on non-compete clauses Tuesday, holding that the agency lacked the authority to issue the ban and that the new rule is “arbitrary and capricious.” The ban , set to go into effect in most of the country on September 4, seeks to prevent employers from restricting where employees can work if an employee chooses to leave the company.
