The Iowa Supreme Court ruled Thursday that plaintiffs cannot recover punitive damages from the state when a law enforcement officer uses excessive force. Punitive damages are awarded as a way to punish the defendant and to deter that same conduct in the future.

The jury found defendant liable for intentional misrepresentation and awarded plaintiff $243,000 in compensatory damages, which was the purchase price of the home, and $250,000 in punitive damages. First, the Court of Appeals found that defendant waived his argument that the evidence supporting fraud was not legally sufficient.

The jury in June 2019 awarded the Gibsons $44 million in compensatory and punitive damages. That pushed the costs back up to more than $36 million for just the damages and interest to the grocery. A judge later reduced the award to $25 million.

According to the majority, only plaintiffs concretely harmed by a defendant’s statutory violation have Article III standing to seek damages against that private defendant in federal court.

The complaint seeks punitive damages. Moreover, they could argue that he was following legal instructions if he did in fact delete the photos. Moreover, the destruction could be cited as adding to the need for punitive damages to deter future such misconduct. Rather than hide the incident, he was disclosing it.
